The CPSU NSW has been made aware that members who were Disability Support Workers with the Department of Family and Communities Services are not being paid the correct rates.
Under Clause 19 d of the Enterprise Bargaining Agreement (EBA), which can be found HERE, members should be paid at the rate of level 2.2. Currently the level 2.2 rate is $34.46 per hour (as increased by the Fair Work Annual Wage Review). The CPSU NSW, however, is in receipt of pay slips which state members on level 2.2 are being paid $33.42 per hour.
This is a clear underpayment.
As such, we request that members who were former Department employees contact the CPSU NSW and provide copies of their pay slips. Northcott must rectify the underpayment and pay members what they are lawfully entitled to. Once further information is received from members, your union will contact Northcott.
Wage increases fall under clause 19 1. c. of the EBA. However, now that the rates in the EBA have expired, increases will be in line with the Fair Work Commission’s Annual Wage review as captured in the Social, Community, Home Care and Disability Services Industry Award 2010 .
