National Heavy Vehicle Regulator Update: your enterprise agreement rights upheld


Recently, members have reported a number of instances where National Heavy Vehicle Regulator (NHVR) management have attempted to bypass the conditions set out in the Enterprise Agreement (EA). These matters have primarily related to the use of private motor vehicles and Rostered Day Off (RDO) entitlements.

Members working under the Marulan Rostering Agreement also reported several instances where local management attempted to alter roster arrangements in direct breach of that agreement.

Your union raised these concerns directly with management and formally put in disputes to ensure the Enterprise Agreement and local agreements are upheld and members’ rights are protected.

As a result of these actions, the following outcomes have occurred:

Marulan members

Management has now backed down from attempts to alter the Marulan rostering arrangements following your union disputing their interpretation. Rosters have been reverted back to the agreed arrangements under the local agreement. This is a positive outcome and confirms the agreement must be respected.

Use of private motor vehicle

The EA is very clear:

Members are only required to use their private vehicle for work if:

  • they agree to do so,
  • management provides prior written approval, and
  • the required travel declaration is submitted (date, purpose, kilometres travelled and vehicle type).

Following the union raising this matter through the dispute process, management has confirmed that this interpretation is correct and are seeking to rectify instances where this agreement may have been breached.

RDO entitlements

Members had been advised by some local managers that if they worked on their scheduled RDO, they could not claim overtime unless NHVR called for ‘volunteers’, and that the hours must instead be banked.

This is not what the EA says.

The EA clearly provides that if a member works on their scheduled RDO, they can choose between two options:

  • Bank the RDO hours to take the day off later; or
  • Be paid overtime for the hours worked.

This is a choice for you to make not management. It exists whether the work occurs because management called for volunteers or because the employee requested to work the day.

Following the union raising a formal dispute, management has confirmed this interpretation is correct and again are seeking to rectify instances where this has been breached.

The Enterprise Agreement and local agreements exist to protect your working conditions and entitlements. This is negotiated directly by your union and management.
