CPSU NSW update: TAFE NSW Update – Managers Enterprise Agreement


Managers Enterprise Agreement – Draft Agreement Tabled

The CPSU NSW bargaining team met with TAFE NSW on 29 November 2023 to continue discussions on issues pertaining to the proposed TAFE Commission of NSW TAFE Managers Enterprise Agreement 2023 (EA).

TAFE NSW tabled a draft EA that includes the following additional clauses and improvement, in line with the CPSU NSW Log of Claims:

  • Improved conversion rights of temporary (fixed-term contract) staff – a reduction from 2 years’ employment to 1 years’ employment before conversion is considered
  • Flexible Working Arrangements – a new clause outlining each employee’s right under Section 65 of the Fair Work Act 2009 (Cth) to request flexible working arrangements, including the ability to request working from home for consideration
  • Restructured Consultation clause – now called “Managing Workplace Change and Consultation” – to be clearer about the stages of a restructure and the role of both TAFE and the CPSU NSW
  • Workload Allocation and Review – a new clause from the CPSU NSW that encourages a review of workload and capacity with escalation to higher management levels if needed.
  • Lactation Breaks – a complete removal of time restrictions
  • The inclusion of the TAFE Guidelines for the Management of Performance and Conduct
  • Annual Leave – a restructuring of the clause with the inclusion of the ability to cash out annual leave in certain circumstances
  • Family and Community Service Leave (FACS) – restructured to make accrual clear
  • Parental Leave – a new clause in line with the negotiated Administrative EA, based on TAFE’s new policies, including improved rights for adoption and surrogacy arrangement

TAFE NSW has also tabled amendments to reduce the average working week from 38 hours to 35 hours a week without loss of pay.

The parties are arranging the next bargaining date(s).
