CPSU NSW consultation with Life Without Barriers on Award expiry


Copied State Awards that apply to Life Without Barriers are set to expire on 22 February 2023. The Fair Work Act 2009 provides a nominal life for Copied State Awards such as the Community Living Award (CLA), of five years from the date services were transferred from the NSW Government provider (FACS/ADHC) to non-government service providers.

The transition from the CLA will be to the relevant modern award, the Social, Community, Home Care and Disability Services Industry Award (SCHCDS Award) and the Fair Work Act.

The CPSU NSW has requested consultation, as required, on the transition ahead of the expiry of Copied State Awards.

On Tuesday 15 November 2022, the CPSU meet with Life Without Barriers to propose the following arrangements apply;

  • Team Leaders and Disability Support Workers current rate of pay is preserved. Clerical staff to also be compensated for any change in hours.
  • The value of your leave is preserved as of the date of transfer. There is no provision for FACS leave under the modern award.
  • Employees transition by letter of advice subject to consultation with the CPSU
  • As continuing employees, current PDs transfer with staff and the CPSU is consulted on any proposed changes to PDs or the structure.

The CPSU NSW has requested a further meeting and will update members on the negotiation.

The CPSU NSW will make an application for a take home pay order for a member who have been moved onto an employment contract and has had an actual reduction in their pay.

The CPSU NSW will continue do everything we can to protect and promote the employment interests of disability services staff in NSW.
